MN-05: White Davis has problems with the FEC

Rep. Keith Ellison's Republican opponent in the MN-05 race has a few problems with the FEC and will most likely be facing a fine. Barbara Davis White did not file her quarterly finance reports online as specified by law.

Under the Commission's mandatory electronic filing rules, which took effect January 1, 2001, any committee that receives contributions or makes expenditures in excess of $50,000 in the current calendar year, or that has reason to expect to do so, must submit its reports electronically. Any filer who is required to file electronically, but instead files on paper, will be considered a nonfiler and may be subject to enforcement action under the administrative fine program. The mandatory electronic filing provisions (11 CFR 104.18) apply to any political committee or other person required to file reports, statements and/or designations with the FEC. These requirements do not apply to Senate candidate committees (and other persons who support Senate candidates only), who file with the Secretary of the Senate

She raised more than $50,000 and she snail-mailed it in. As you can see the FEC received it on 10/15 ... which probably means it was late, too. I thought that the filing deadline was earlier, Davis White's paperwork wasn't late, just filed incorrectly.

Can Davis White do anything right?

She was told by the Minnesota Republican Party to shut up when she was going to complain about the lack of support from the party. She is unable to get her own party to get behind her.

She failed to file her pre-primary report:

The Federal Election Commission (FEC) cited four campaign committees today for failing to file the Pre-Primary Report required by the Federal Election Campaign Act (the Act) for primary elections on September 9.

As of 5 p.m. September 5, 2008, the required disclosure report had not been received from Barb Davis White for Congress, the principal campaign committee for Barbara Davis White in Minnesota's 5th district whose treasurer is Ly'neys Rita Hill; Higgins for Congress, the principal campaign committee for Brian Higgins in New York's 27th district whose treasurer is Gary M. Kanaley; Friends of Graham Long, principal campaign committee for Graham E. Long in New York's 3rd district whose treasurer is Anita Long; and Stark for Congress, principal campaign committee for Paul Stark in Wisconsin's 3rd district whose treasurer is John Sackett.
